Terms of Service

You must be at least 18 years old and legally capable of entering into a binding agreement to use Hestia.

By using the Services, you represent that all information you provide is accurate and complete.

Hestia provides property management technology tools that may include:

• Resident portals
• Owner portals
• Rent payment systems
• Lease management
• Maintenance request systems
• Messaging tools
• Reporting tools
• Document storage
• Screening integrations
• Other housing-related services

Some features may vary by property or subscription plan.

Users may be required to create an account. You agree to:

• Maintain accurate information
• Keep login credentials secure
• Notify us of unauthorized use
• Accept responsibility for activity under your account

We reserve the right to suspend accounts for fraud, misuse, or violations of these Terms.

If payments are enabled:

• Rent, fees, deposits, or subscriptions may be processed through third-party providers such as Stripe.
• Users authorize applicable charges when submitting payment.
• Processing fees may apply where permitted.
• Failed or reversed payments may result in additional fees or restrictions.

Hestia is not a bank and does not hold funds as a financial institution.

Hestia is a software platform.

Unless explicitly stated in a separate written agreement, Hestia is not the landlord, property owner, leasing agent, legal representative, or property manager of listed properties.

Property owners and managers remain responsible for:

• Lease compliance
• Fair housing compliance
• Habitability obligations
• Notices and disclosures
• Security deposit handling
• Legal compliance

Users agree not to:

• Use the platform unlawfully
• Submit false information
• Harass others
• Attempt unauthorized access
• Upload malicious files
• Interfere with system operations
• Use Hestia for discriminatory housing practices

Users must comply with all applicable fair housing and anti-discrimination laws, including but not limited to the U.S. Department of Housing and Urban Development Fair Housing Act and applicable state/local laws.

Hestia may suspend users engaged in discriminatory conduct.

Maintenance requests submitted through Hestia are notifications only.

Submission of a request does not guarantee immediate repair, emergency response, or legal notice unless otherwise required by law or separately agreed by the property manager.

For emergencies, users should contact local emergency services or the property directly.

Users retain ownership of content they upload, but grant Hestia permission to host, process, and display such content as necessary to provide Services.

Users are responsible for ensuring uploaded materials are lawful and accurate.

We strive for reliable service but do not guarantee uninterrupted access.

We may modify, suspend, or discontinue features at any time.

Hestia may integrate with third-party providers including:

• Payment processors
• Email/SMS services
• Screening providers
• Accounting tools
• Cloud storage providers

Use of those services may also be subject to their terms.

Services are provided "as is" and "as available" without warranties of any kind, express or implied.

We do not guarantee:

• Error-free operation
• Continuous uptime
• Legal compliance by users
• Payment collection success
• Tenant screening outcomes

To the maximum extent permitted by law, Hestia shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Our total liability shall not exceed the amount paid to Hestia in the prior 12 months, if any.

Users agree to defend and indemnify Hestia from claims arising from:

• User misconduct
• Lease disputes
• Housing law violations
• Uploaded content
• Use of the Services

We may suspend or terminate accounts for violation of these Terms or misuse of the platform.

Users may stop using Hestia at any time.

These Terms shall be governed by the laws of the State of North Carolina, unless otherwise required by applicable law.

We may update these Terms periodically. Continued use after updates constitutes acceptance.
